Lawmakers offer to implement a Unified Court Records System into criminal proceedings. The Parliament registered the respective changes stipulated in Draft Law №8219 on 23.11.2022.
What does it mean?
The document changes a range of articles of the Criminal Proceeding Code of Ukraine (CPCU) and its final provisions for launching some of UCRS’s subsystems.
For instance, article 35 of the CPCU contains an option for case participants to submit procedural documents to the court in digital form through the UCRS.
Article 135 of the CPCU could receive an extra paragraph: “Upon the existence of the respective participant’s written application and technical possibility, text messages could serve as a notice for such a participant to appear at the court according to the procedure established by the Regulation on the UCRS and/or provisions regulating processes for some UCRS’s subsystems (modules).
We have to emphasize some alterations offered to article 136 of the CPCU, namely: “Provided that the UCRS and/or its separate subsystem (module) is applied, the day of handing a notice to appear to an investigating judge, or court is the day when the court receives the acknowledgement of the delivery of the respective subpoena to the person’s official e-mail address”.
Within this context, it is essential to remind Draft Law 7574-d, offering to impose the obligation to have a registered cabinet at the UCSR on all legal entities and individual entrepreneurs, passed in general on 04.11.2022.
Another innovation of the Draft Law №8219 is the choice and appointment of jurors through UCRS modules (alterations to articles 385 and 386 of the CPCU). Offered changes to article 336 of the CPCU will enable participants of criminal proceedings to participate in a court hearing in a videoconference mode, out of the court’s premises and with their own technical means.
Authors of the Draft Law №8219 believe that said changes will ensure the efficient start for the implementation of the UCRS.
