uResidency: An Innovative Approach to Attracting Foreign Entrepreneurs to the Jurisdiction of Ukraine.

In light of the modern challenges faced by Ukraine due to the full-scale invasion by the Russian Federation, the state continues to seek new opportunities to support the economy and attract foreign capital. One of these innovative solutions is the uResidency program—an electronic residency for foreigners wishing to do business within the Ukrainian jurisdiction. This initiative, supported by the European Union and spearheaded by the Ministry of Digital Transformation, aims not only to strengthen Ukraine’s economic position but also to open new pathways for integrating the country into the global business community.

This program is particularly relevant at a time when Ukraine is striving for the quickest possible recovery and stabilization of its economy. The implementation of uResidency will enable additional budget revenues through taxes from e-residents, which, in the context of war, is a significant factor in supporting the financial stability of the country.

Moreover, the program will help improve Ukraine’s international image as a reliable partner for conducting business.

Let me remind you that on April 1, 2023, the Law of Ukraine No. 2654-IX came into force, which amends the Tax Code and other laws regarding the peculiarities of taxation of entrepreneurial activities of electronic residents. Thanks to this law, foreigners gained the opportunity to register as entrepreneurs in Ukraine (E-residents).

Advantages for Foreigners.

An important element of uResidency is that it allows foreigners to quickly register a business in Ukraine, earn income from abroad, and pay taxes in a simple and transparent manner. Special tax conditions—fixed at 5% of the income amount (if the turnover does not exceed the limits for the third group of individual entrepreneurs) and 15% (if the limits are exceeded)—make Ukraine attractive for IT specialists, freelancers, and entrepreneurs from around the world. The automated tax payment and reporting system minimizes bureaucracy and allows business people to focus on developing their projects.

Additionally, E-residency will provide foreigners with the opportunity to:

  • Manage businesses remotely using modern digital solutions;
  • Sign documents using an electronic signature;
  • Open and manage bank accounts online;
  • Benefit from preferential tax conditions.

Restrictions.
Only those foreigners who do not earn income in Ukraine can become E-residents. This means that their activities will be directed solely towards providing services to foreign clients. The law also prohibits citizens of the Russian Federation and countries on the “gray” or “black” lists of the FATF from obtaining E-resident status. The FATF (Financial Action Task Force) list includes countries with deficiencies in combating money laundering and the financing of terrorism. Countries on the “gray” list are considered those that do not meet all standards but are actively working on corrections. Countries on the “black” list have significant deficiencies and do not cooperate with the FATF.

How to Become an E-resident?

Foreigners can become E-residents of Ukraine remotely, without the need for physical presence in the country. Potential applicants must submit an online application through a specialized mobile application or the official website of the E-residency program. After that, they need to go through the identification procedure at the nearest Ukrainian consulate, which ensures confirmation of identity for obtaining E-resident status. Additionally, E-residents must open a bank account in a financial institution in Ukraine for business operations. In the future, plans are underway to introduce a fully digital identification procedure, making the process even more convenient and accessible online.

When Will the UResidency Program Start?

The full launch of the program began in September. At the first stage, the UResidency service will be available to citizens of Slovenia, India, Pakistan, and Thailand, with further expansion planned for other countries. The Ministry of Economy of Ukraine notes that the main focus of uResidency is directed towards IT specialists from Asia and Europe.

Against the backdrop of war, the launch of UResidency is also significant for diplomatic relations, as it demonstrates that Ukraine, despite all its difficulties, is not halting its path towards innovation and modernization. UResidency becomes another tool in forming the economic resilience of the state, helping to attract investments and increase trust in the Ukrainian jurisdiction at the international level. Thus, the uResidency program not only provides new opportunities for doing business in Ukraine but also becomes an essential element of the strategy for the economic survival and recovery of the country under martial law.
