Ukrainians will be able to use an electronic signature (electronic trust services) in the European Union. The appropriate Decree by CMU No. 1311 of 22.11.2022 came into force on 25.11.2022.
What does it mean?
The founder and CEO of “Incolanse” Law Company, PhD in Law and lawyer, Olha Drachevska explains that on 07.11.2018, the Law “On Electronic Trust Services” came into force, having implemented modern personal electronic identification services in Ukraine and provided Ukrainians with modern tools for electronic business and communication with partners and the state.
Thus, the Government decided on a Procedure to implement an experimental project on mutual recognition of the electronic trust services between Ukraine and the EU till 20.08.2024.
This recognition shall enable Ukrainians to receive some services and identify their personalities much easier.
“DIIA” State Enterprise will administer and operate the experimental Trust list.
The Government has created a list of states with adequate data protection; it is an enclosure to the decree by the Cabinet of Ministers of Ukraine of 16.08.2022 No. 910. An electronic signature done in one of the listed countries enables a Ukrainian abroad to access information stated in electronic documents, submit relevant copies of electronic papers, and receive public services out of the territory of Ukraine. Such digital signatures shall be equivalent to personal signatures on the documents, confirming those states’ participation in transferring digital copies of the respective papers and obtaining public services exceptionally out of the territory of Ukraine.
Foreign qualified trust services provided with qualified trust services providers in the states of the EU and other states – members of the European Economic Area, included in the Register of trust lists of the European Union shall be qualified electronic trust services, and the results after such services shall be qualified electronic signatures according to the Law of Ukraine “On Electronic Trust Services”;
